Please read these Terms and Conditions carefully before placing an order on www.bargainia.com. By placing an order, you confirm that you have read, understood and agree to be bound by these Terms and Conditions in their entirety. If you do not agree, please do not place an order.

These Terms and Conditions constitute a legally binding contract between you (the Buyer) and Bravich LTD trading as Bargainia.com (the Seller, we, us, our). They apply to all orders placed through www.bargainia.com and are governed by the laws of England and Wales.


Conditions of Sale

  • These Terms and Conditions apply to all orders placed on www.bargainia.com. By placing an order, the Buyer agrees to be bound by these Terms and Conditions in full.
  • All products available on this website are intended for non-commercial, private domestic use only.
  • These Terms and Conditions do not confer consumer rights on any Buyer purchasing goods for business or commercial purposes.
  • Submission of an order constitutes an offer by the Buyer to purchase the goods. No contract is formed until the Seller sends the Buyer an Order Confirmation email. An automated acknowledgement of receipt of an order does not constitute acceptance.
  • The Order Confirmation will set out the specific details of the order, including product description and applicable delivery charges. It is the Buyer's responsibility to check that the goods specified in the Order Confirmation correspond to those intended to be ordered. If there is any discrepancy, the Buyer should contact us at info@bargainia.com as soon as possible.
  • It is the Buyer's sole responsibility to ensure that all details provided at checkout are accurate and complete, including the delivery address, email address and contact telephone number. Bargainia.com cannot be held responsible for any failed, delayed or misdirected delivery arising from inaccurate information provided by the Buyer.
  • If the Buyer identifies an error in the delivery address after placing an order, they must contact us at info@bargainia.com as soon as possible. Whilst we will make reasonable efforts to accommodate an address change request, we cannot guarantee that this will be possible. Depending on the payment provider or courier used, we may be unable to facilitate a change of address once an order has been processed or dispatched.
  • Where a delivery fails or requires return as a result of an incorrect address provided by the Buyer, or where an address change cannot be facilitated, the Buyer will be responsible for any failed delivery and return charges incurred. These charges will vary depending on the size and weight of the item and the courier used, and will be deducted from any refund due.
  • Goods will be dispatched as soon as they are available. Where an order contains multiple items, these may be dispatched in separate consignments as stock becomes available.
  • In the event that a product is listed at an incorrect price due to a typographical, system or pricing error, Bargainia.com is not obliged to fulfil the order at the incorrect price. We reserve the right to cancel the order and issue a full refund. The Buyer will be notified as soon as reasonably practicable. This does not affect the Buyer's statutory rights.


Price and Payment

  • The price payable for goods is the price displayed on the website at the time the order is placed. All prices are inclusive of VAT at the applicable rate. Delivery charges are shown separately at checkout and vary by order and fulfilment method.
  • Goods will not be dispatched until payment has been received and cleared in full.
  • We accept the following payment methods: credit and debit card, PayPal, bank transfer, Klarna and Clearpay. All payments must be made through the payment providers available on www.bargainia.com. We do not accept payment by any other means.
  • Orders paid via PayPal can only be delivered to the delivery address registered and confirmed within the Buyer's PayPal account.
  • If you use a buy now, pay later or financing option such as Klarna or Clearpay, that agreement is solely between you and the finance provider. Bargainia.com is not a party to that agreement and cannot be held responsible for any charges, interest, technical errors or decisions made by the provider.   • In the event of overpayment by the Buyer, Bargainia.com will refund only the amount overpaid. We cannot be held responsible for any bank charges or interest incurred as a result.
  • We operate automated fraud screening on all orders. We reserve the right to contact the Buyer to verify certain details within 5 working days of an order being placed. If we do not receive the required information within that period, the order may be cancelled and a full refund issued. We are not able to disclose the criteria used in our fraud screening process.
  • If the Buyer raises a chargeback or payment dispute with their bank or payment provider without first contacting us, we reserve the right to submit all available evidence in response, including proof of delivery, GPS tracking data, delivery photographs and correspondence. We encourage all Buyers to contact us directly before raising a dispute, as most issues can be resolved quickly and without the need for third-party intervention.
  • We reserve the right to refuse further orders from, and permanently close the account of, any Buyer found to be engaging in fraudulent activity. Fraudulent activity includes, but is not limited to: raising unsubstantiated chargebacks or payment disputes; submitting false claims of non-receipt; returning used, damaged or substituted items; and any other conduct intended to obtain a financial benefit by deception. We reserve the right to report such activity to the relevant authorities and to pursue recovery through legal proceedings where appropriate.


Products and Descriptions

  • Product images displayed on our website are for illustrative purposes only. Colours, shades and finishes may vary due to screen calibration, differences between production batches, or the natural characteristics of certain materials. Dimensions are estimates and may vary slightly. Such variations do not constitute a defect unless they render the product unfit for its intended purpose.
  • Items shown alongside a product in an image, such as accessories, lamps, bedding or decorative objects, are not included in the order unless explicitly stated in the product description.
  • Where products are made from natural materials including solid wood, marble, stone, rattan or similar, each item will be unique in appearance. Variations in grain, texture, tone, marking and finish are inherent characteristics of natural materials and are not defects. Such variations are to be expected and do not entitle the Buyer to return the goods.
  • Bespoke and made-to-order items are manufactured to the Buyer's specific requirements and cannot be returned on the grounds of change of mind. It is the Buyer's sole responsibility to ensure that all measurements, specifications and requirements provided at the time of ordering are accurate and complete. Bargainia.com accepts no liability for errors in specifications provided by the Buyer.


Marketplace and Third-Party Vendors

  • Bargainia.com operates both as a direct seller of its own stock and as a marketplace platform through which approved third-party vendors may list and sell products. Where an order contains products sold by a third-party vendor, this will be clearly indicated on the product listing page, which will also set out the vendor's identity, shipping information and returns conditions.
  • Where Bargainia.com is the named seller on the Order Confirmation, Bargainia.com is the contracting party for that transaction. Where a third-party vendor is identified as the seller on the listing, the contract for the purchase of those goods is between the Buyer and that vendor. Bargainia.com acts as the payment collection agent and marketplace operator in such transactions.
  • Regardless of whether goods are sold by Bargainia.com directly or by a third-party vendor, all payments are collected by Bargainia.com on behalf of the seller. The receipt and Order Confirmation will always be issued by Bargainia.com.
  • All third-party vendors are required to enter into a formal seller agreement with Bargainia.com before listing products on the platform. All products are reviewed and approved by Bargainia.com prior to being made available for sale. Notwithstanding this, Bargainia.com does not manufacture, inspect or warehouse third-party vendor products and is not responsible for any product defect, inaccuracy or safety issue arising from a vendor product. Liability for product safety, accuracy of description and compliance with applicable legislation remains solely with the vendor as manufacturer, importer or distributor.
  • Where a third-party vendor fails to fulfil an order, Bargainia.com will contact the vendor on the Buyer's behalf and, where the vendor cannot fulfil the order, will arrange a full refund to the Buyer. Bargainia.com reserves the right to recover any such costs from the vendor under the terms of the seller agreement.
  • All returns for third-party vendor products must be raised through Bargainia.com's customer service team. The applicable returns window and conditions will be as set out on the vendor's product listing page. Regardless of the vendor's own policy, the Buyer's statutory rights under the Consumer Rights Act 2015 apply in full and are not affected or limited by any vendor policy.
  • Where a third-party vendor ceases trading or becomes uncontactable after an order has been placed, Bargainia.com will issue a full refund to the Buyer and seek to recover that amount from the vendor.


Delivery

General Delivery Terms

  • Delivery will be made to the address provided at checkout. It is the Buyer's responsibility to ensure that all checkout details are accurate, including the delivery address, email address and contact telephone number. Bargainia.com cannot be held responsible for failed or delayed delivery resulting from inaccurate information provided by the Buyer.
  • Delivery timescales are estimates only. We will make all reasonable efforts to meet any estimated delivery date but cannot be held responsible for delays outside our reasonable control.
  • For standard courier deliveries, delivery is to the front door of the delivery address only. For large item two-man deliveries delivery is to a room of the Buyer's choice, subject to clear and safe access. For health and safety reasons, delivery personnel are not required to remove footwear. The Buyer is advised to protect floors and surfaces accordingly.
  • Risk in the goods passes to the Buyer upon delivery to the delivery address. Where the Buyer has authorised delivery to a safe place or to a nominated third party, risk passes upon completion of that delivery.
  • Some items require assembly. Assembly is the sole responsibility of the Buyer. If the Buyer requires assistance with assembly instructions, they are welcome to contact our customer service team at info@bargainia.com.
  • The Buyer is responsible for monitoring tracking information, responding promptly to delivery notifications and ensuring that a suitable person is available to accept delivery. Tracking is provided directly by the courier and is outside Bargainia.com's control.
  • We are unable to hold goods indefinitely. If no delivery can be arranged within 10 working days of goods becoming available, we reserve the right to cancel the order and charge a return fee. If a scheduled delivery has not taken place or the Buyer has received no further contact from the courier, the Buyer must contact us within 3 working days.


Standard Courier Deliveries

  • Smaller items and rugs are dispatched via our standard courier service. Estimated delivery timescales are 1 to 5 working days following dispatch, based on the courier's suggested time scales on checkout.
  • Standard couriers will make a limited number of delivery attempts. If the final delivery attempt is unsuccessful, the parcel will be returned to us and a return shipping charge may be deducted from any refund due.
  • If there has been no tracking movement for 7 to 10 working days since the last recorded scan, we will open an investigation with the courier. We are unable to raise a formal claim until the courier's own investigation threshold has been met.
  • Couriers may on occasion leave a parcel in a safe place or with a neighbour. Where the Buyer has pre-selected this option, Bargainia.com cannot be held responsible if the parcel is not subsequently located. Where the driver made an independent decision to leave the parcel without the Buyer's prior consent, the Denial of Receipt process set out below will apply.


Large Item Two-Man Deliveries

  • Larger items such as furniture are delivered by a specialist two-man courier service. Once dispatched, the courier will contact the Buyer directly by SMS to arrange a delivery slot. It is the Buyer's responsibility to ensure the contact number provided at checkout is correct and that all messages from the courier are responded to promptly.
  • Two-man deliveries are estimated to take between 5 and 10 working days following dispatch. A pre-booked delivery slot will be arranged directly between the courier and the Buyer. The courier will hold the order for a maximum of 14 days from the date of dispatch. If a delivery date is not confirmed within this period, the order will be returned to us and charges will apply.
  • It is the Buyer's responsibility to check measurements and confirm that the goods will fit through all access points before the delivery team arrives. If goods cannot be delivered due to access or sizing issues on the day of delivery, failed delivery and return charges will apply as set out below.


Vendor Fulfilled Orders

  • Where an order is fulfilled directly by a third-party vendor, the vendor's own delivery timescales and conditions will apply. These are displayed on the relevant product listing page at the time of purchase. Bargainia.com is not responsible for delays or issues arising from vendor-managed fulfilment, but will assist the Buyer in raising any issues with the vendor.


Delivery Charges

  • Delivery charges vary by order and fulfilment method. The applicable charge will be clearly displayed at checkout prior to the Buyer completing their order. Delivery charges are non-refundable once goods have been dispatched, except where the return arises from a fault, defect or incorrect item attributable to Bargainia.com or the vendor.


Failed Delivery and Associated Charges

  • If the Buyer cancels the order or refuses delivery after the goods have been dispatched, we reserve the right to deduct a failed delivery charge of up to £65 and a return charge of up to £65 from any refund due. Delivery charges paid at the time of order are non-refundable in these circumstances.
  • If the Buyer rejects delivery at the door, a failed delivery charge of up to £65 and a return charge of up to £65 will be deducted from any refund due.
  • For two-man large item deliveries, the following charges apply:
  • If no delivery date is confirmed within 14 days of dispatch: failed delivery charge of up to £65 and return charge of up to £65.
  • If a confirmed delivery date is cancelled with less than 48 hours' notice: failed delivery charge of up to £65 and return charge of up to £65.
  • If the courier attempts delivery and the Buyer is not present or refuses the delivery: failed delivery charge of up to £65 and return charge of up to £65.
  • If goods cannot be delivered because they do not fit: failed delivery charge of up to £65 and return charge of up to £65. It is the Buyer's responsibility to check measurements prior to ordering.
  • If the Buyer has provided an incorrect delivery address and the order has already been dispatched, the Buyer remains responsible for any additional delivery or return charges that result. These will be deducted from any refund due.
  • All two-man delivery charges will be deducted from any refund due.


Damaged Goods

  • The Buyer is strongly advised to inspect all goods at the point of delivery. Where goods are delivered by two-man courier and the outer packaging or the item itself is visibly damaged at the time of delivery, the Buyer should refuse the delivery and contact us as soon as possible. Accepting a visibly damaged delivery may affect the Buyer's ability to make a claim.
  • Following delivery, all goods should be inspected as soon as reasonably practicable. Any visible damage must be reported to us as soon as possible and no later than 30 days from the date of delivery. Reports must be submitted by email to info@bargainia.com with the order number, a description of the damage and supporting photographic evidence. We reserve the right to close a damage claim if photographic evidence is not provided.
  • Where damage is reported after 30 days, we will consider the claim at our discretion. The Buyer's statutory rights under the Consumer Rights Act 2015 are not affected by this timeframe.
  • Upon receipt of a valid damage report, we will open an investigation and may require additional information to assess the claim. We will advise the Buyer of the outcome and the appropriate remedy as soon as reasonably practicable.


Cancellation

  • The Buyer should notify us as soon as possible of any wish to cancel an order. Notification of a wish to cancel does not guarantee that cancellation will be possible.
  • If goods have already been dispatched at the time a cancellation request is received, we are unable to cancel the order prior to delivery. If the Buyer rejects the delivery, a return charge of up to £85 may be deducted from any refund due. Delivery charges are non-refundable once goods have been dispatched.
  • Consumers have the right to cancel an order within 14 calendar days of placing an order in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This right does not apply to the exempt categories of goods listed in the Returns section below. Written notice of cancellation must be given within this 14-day period by emailing info@bargainia.com. If the goods have already been delivered, they must be returned unused and in their original packaging.
  • Where goods are cancelled during the 14-day cooling-off period, Bargainia.com will issue a refund within 14 days of receiving the returned goods or proof of return, whichever is earlier. The original delivery charge is non-refundable. We reserve the right to make a deduction from the refund where the value of the goods has been diminished by handling beyond what is necessary to establish their nature, characteristics and functioning.
  • If the Buyer has provided an incorrect delivery address and the order has already been dispatched, the Buyer remains responsible for any additional delivery or return charges arising. These may be deducted from any refund due.


Returns

Own Stock Items

  • The Buyer has 30 days from the date of delivery to return Bargainia.com own stock items. All returns must be authorised by us before goods are sent back. To request a return, please email info@bargainia.com with your order number and reason for return.
  • Goods must be returned unused, in their original packaging and in the same condition as received. We reserve the right to refuse a refund where goods are returned used, not in their original packaging, or where the packaging does not contain the item originally purchased.
  • Where a return arises from a fault, defect or incorrect item attributable to Bargainia.com, we will arrange and meet the cost of collection. Where a return arises from a change of mind, the Buyer is responsible for arranging and meeting the cost of return postage or collection.
  • Refunds for authorised returns will be processed within 7 days of receipt of the returned goods. The original delivery charge is non-refundable.


Third-Party Vendor Products

  • The applicable returns window and conditions for third-party vendor products are set out on the relevant product listing page. All returns must be raised through our customer service team regardless of the vendor's identity. The Buyer's statutory rights under the Consumer Rights Act 2015 apply in full regardless of the vendor's own returns policy.


Large Item Collections Arranged by Us

  • All items must be in their original packaging for collection. If a confirmed collection fails because the item was not adequately packaged, was not available for collection, or the address provided was incorrect, a failed collection charge of up to £135 may be deducted from any refund due.
  • Any changes to a confirmed collection must be communicated directly to the courier no later than 12 noon on the day before the scheduled collection. Failure to do so may result in a charge of up to £65 per missed collection.


Incorrect Orders

  • The Buyer must inform us within 7 days of delivery if they have received an incorrect item. The return will be arranged by our customer service team. It is the Buyer's responsibility to return the item in its original packaging, prepared for shipment. A full refund will be issued within 7 days of receipt of the returned item.


Goods Exempt from Returns

  • The following goods cannot be returned: bespoke and made-to-order items; perishable goods including food, flowers and newspapers; pillows, mattress protectors, duvets and bed linen where the original sealed packaging has been opened, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
  • Nothing in this section affects the Buyer's statutory rights in respect of faulty, damaged or misdescribed goods.


Delivery Disputes and Denial of Receipt

  • Where a courier has marked an order as delivered and the Buyer believes they have not received it, the Buyer should contact us as soon as possible. We will provide all available delivery evidence, including photographs and GPS data, and ask the Buyer to check around the property and with neighbours before a formal investigation is opened.
  • If the Buyer is still unable to locate the parcel, they will be required to complete a Denial of Receipt declaration. This is a signed document confirming non-receipt of the goods. The completed declaration must be returned to us within 5 working days of our request. We are unable to progress a claim or take any further action until the signed declaration has been received. Once received within the required timeframe, we will work to resolve the matter as promptly as possible. Where a declaration is not returned within 5 working days, Bargainia.com reserves the right to take no further action in respect of that claim.


Furniture Guarantee

  • Bargainia.com provides a one-year manufacturing guarantee on all furniture sold directly by us, running from the date of delivery. This guarantee is provided in addition to, and does not affect, your statutory rights under the Consumer Rights Act 2015. Third-party vendor furniture products are covered by the relevant vendor's own guarantee, details of which are available on the product listing page.
  • The guarantee covers manufacturing faults and structural defects present at the time of manufacture. It does not cover fair wear and tear, accidental damage, misuse, or damage resulting from failure to follow the assembly or care instructions provided.
  • If you experience any issue with your item, please contact us as soon as possible at info@bargainia.com with your order number, a description of the issue and supporting photographs or video. We will assess the matter and advise on the next steps.
  • Any modification, repair, alteration or attempted fix carried out by the Buyer or any third party not authorised by Bargainia.com will void the guarantee with immediate effect. Bargainia.com accepts no liability for any damage, injury or loss arising from or in connection with such modifications or repairs.
  • Bargainia.com reserves the right to inspect any item upon return before a guarantee claim is assessed or a remedy offered.
  • The Buyer is required to cooperate fully with any guarantee investigation and must respond to any request for information, photographs or supporting evidence within 5 working days of that request being made. Where the Buyer fails to respond within this timeframe, Bargainia.com reserves the right to close the case and take no further action in respect of that claim.
  • After the expiry of the one-year guarantee period, your statutory rights under the Consumer Rights Act 2015 continue to apply. Claims may be brought for up to six years from the date of delivery under applicable law.


Promotions, Offers, Reviews and Discount Codes

Promotions and Offers

  • From time to time, Bargainia.com may offer promotional pricing, discount codes, flash sales or other offers. All such promotions are subject to availability and may be withdrawn or amended at any time without notice.
  • Promotional pricing applies only to orders placed during the promotional period and cannot be applied retrospectively to orders already placed.
  • In the event of a dispute regarding a promotional price or discount code, Bargainia.com's decision is final.

Discount Codes

  • Discount codes and partial refunds issued as a gesture of goodwill do not constitute an admission of liability on the part of Bargainia.com.
  • Bargainia.com discount codes are personal to the recipient, non-transferable and may not be sold or passed to a third party. They cannot be combined with any other offer, promotion or discount code unless explicitly stated. Each code is limited to one use per customer and may be withdrawn at any time without notice.
  • Bargainia.com discount codes apply to Bargainia.com own stock products only and may not be applied to products listed by third-party vendors on the platform.
  • Third-party vendors may issue their own discount codes independently. Where applicable, you will be notified of vendor promotions via our newsletter. To receive these notifications, please ensure you are subscribed to the Bargainia.com newsletter.

Reviews

  • We welcome honest reviews from customers on platforms including Trustpilot, Google, Judge.me and any other review platform we may use from time to time. By submitting a review, you confirm that it is based on a genuine experience with Bargainia.com, is truthful and accurate, and does not contain defamatory, offensive or misleading content.
  • We may contact customers following a purchase to invite a review and may respond publicly to feedback posted on any platform. Where an issue has been resolved, we may ask whether the customer would like to update a negative review. This is always voluntary and will never be made a condition of receiving a refund, resolution or any other benefit. We reserve the right to report to the relevant platform any review that appears fraudulent, defamatory or in breach of that platform's guidelines.


Complaints and Disputes

  • If you have a complaint, please contact our customer service team at info@bargainia.com, including your order number and a full description of the issue. We will acknowledge all complaints and aim to provide a substantive response within 10 working days.
  • Bargainia.com does not currently participate in a formal Alternative Dispute Resolution (ADR) scheme. If a complaint cannot be resolved directly, the Buyer is free to seek resolution through a recognised ADR provider of their choice. Bargainia.com will cooperate fully with any legally authorised process. Nothing in these Terms and Conditions affects the Buyer's right to bring proceedings before a court of competent jurisdiction.


Limitations of Liability

  • The total liability of Bravich LTD trading as Bargainia.com, whether in contract, tort (including negligence) or otherwise, arising out of or in connection with any order shall not exceed the total value of the goods forming the subject of that order, as stated in the Order Confirmation.
  • To the fullest extent permitted by applicable law, Bargainia.com shall not be liable for any indirect, consequential or economic loss, including but not limited to loss of profit, loss of revenue, loss of anticipated savings or loss of data, arising out of or in connection with the performance or non-performance of any contract.
  • Nothing in these Terms and Conditions excludes or limits liability for: death or personal injury caused by negligence; fraudulent misrepresentation; any breach of the implied terms as to title under the Sale of Goods Act 1979; or any other liability that cannot be excluded or limited under applicable law, including the Consumer Rights Act 2015.
  • Neither party shall be liable for any delay or failure to perform any of its obligations under a contract where such delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, fire, flood, severe weather, industrial disputes, pandemics, governmental action or failure of third-party carriers. In such circumstances, the affected party will notify the other as soon as reasonably practicable. If the delay continues for more than 30 days, either party may cancel the order and, where payment has been made, a full refund will be issued.


Your Data and Privacy

  • We are committed to protecting your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. By placing an order, you acknowledge that your personal information may be shared with the vendor or courier responsible for fulfilling and delivering your order. This sharing is necessary for the performance of the contract and is carried out securely.
  • Your data will not be shared with any third party for marketing purposes without your explicit consent.

Intellectual Property

  • All content on this website, including product descriptions, photography, video, graphics, logos, trade marks and written copy, is the property of Bravich LTD trading as Bargainia.com or its licensed suppliers and is protected under applicable copyright and intellectual property law.
  • No content from this website may be reproduced, distributed, republished or used for any commercial purpose without the prior written permission of Bargainia.com. Unauthorised use may give rise to a claim for damages and may constitute a criminal offence.


Website Use

  • Bargainia.com makes reasonable efforts to ensure that the information on this website is accurate and up to date, but makes no warranty or representation as to its accuracy, completeness or fitness for any particular purpose. We reserve the right to amend, withdraw or remove any content, product listing or functionality on this website at any time without notice.
  • We do not guarantee that this website will be available at all times or free from technical errors, viruses or other harmful components. We will not be liable for any loss or damage arising from your use of, or inability to access, this website.

Governing Law and Jurisdiction

  • These Terms and Conditions and any contract formed between the Buyer and Bargainia.com are governed by and construed in accordance with the laws of England and Wales.
